Welcome to Adéle Geldenhuys Art. By using this website or purchasing any product from us, you agree to these Terms & Conditions.

These Terms & Conditions are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and applicable privacy legislation.

 

1. ABOUT US

2. WEBSITE USE

The content of this website is provided for general information and shopping purposes.

You may not copy, reproduce, modify, distribute, sell or commercially exploit any artwork, photograph, design, text, logo or other content belonging to Adéle Geldenhuys Art without prior written permission.

We reserve the right to correct website errors, update product information, change prices and discontinue products where reasonably necessary.

 

3. ARTWORK AND PRODUCT INFORMATION

Every original artwork is created by Adéle Geldenhuys.

Because many products are individually made, printed or finished to order, slight differences may occur between the product shown on screen and the finished product.

Colours may vary slightly because of:

• different computer, tablet or phone screens;

• photographic lighting;

• printing processes;

• the material on which the artwork is printed.

These variations are not considered defects where the product is substantially consistent with the description and images provided.

Measurements are approximate unless specifically stated otherwise.

 

4. ORIGINAL ARTWORK

Original artworks are unique pieces.

Once an original artwork has been sold, it may no longer be available.

Where an artwork is described as “ready to hang”, this means it has been prepared for hanging as stated in the individual product description.

The artwork remains the intellectual property of Adéle Geldenhuys even after the physical original has been sold. Purchase of an artwork does not transfer copyright.

 

5. MADE-TO-ORDER PRODUCTS

Many of our products are made to order.

This may include printed décor, bags, textiles, cushions, blankets, mats, clothing, stationery and other products.

Made-to-order products may require additional manufacturing time.

Our current estimated production period may be 6–9 weeks, depending on the product, printing schedule and sewing/production availability.

Where a specific production or delivery estimate is provided on the product page or in writing, that estimate will apply to the relevant order.

Production times may occasionally be affected by supplier, manufacturing, printing, courier or other circumstances outside our reasonable control.

 

6. CUSTOM AND PERSONALised ORDERS

Where a product is made according to a customer's specific requirements, measurements, artwork, wording, colour selection or other specifications, it may be considered a customised or personalised product.

Customers are responsible for checking and approving information supplied for customised orders before production begins.

Once production has started, customised orders may not be cancelled simply because the customer has changed their mind, subject always to the customer's rights under applicable South African law.

 

7. PRICES

All prices displayed on the website are in South African Rand (ZAR) unless otherwise stated.

Prices are subject to change without prior notice.

The price applicable to an order is the price displayed at the time the order is placed, subject to correction of obvious pricing errors.

Where applicable, delivery, courier or other charges will be shown separately or calculated at checkout.

We reserve the right to correct genuine pricing or description errors. If an obvious error has resulted in an order being placed, we will contact the customer before processing the order.

 

8. PAYMENT

Payment must be made using the payment methods offered on the website or by another payment method specifically agreed with Adéle Geldenhuys Art.

For manual payments, payment is due within 3 days unless otherwise agreed in writing.

An order will only be placed into production once the required payment has been received and cleared.

For commissioned or specially produced artwork, a deposit may be required. Where a deposit is specified, the balance must be paid according to the agreed payment terms before delivery or collection.

We do not accept responsibility for delays caused by incorrect payment references, incorrect banking details supplied by the customer, unpaid transactions or payment processing delays.

 

9. ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase.

An automated order confirmation confirms that we have received your order; it does not necessarily mean that the order has been accepted for production.

We reserve the right to decline or cancel an order where there is a legitimate reason, including stock or production limitations, incorrect pricing, suspected fraudulent activity or an inability to fulfil the order.

If we cancel an order after payment has been received, any refund due will be processed in accordance with applicable law.

 

10. DELIVERY AND SHIPPING

We deliver within South Africa and may offer international delivery where specifically agreed.

Delivery charges will be displayed at checkout or communicated to the customer before an order is confirmed.

Our products may be delivered by an independent courier or other delivery service.

Once an order has been dispatched, the customer will receive available tracking information where applicable.

Estimated delivery times are not guaranteed and may be affected by courier delays, weather, public holidays, remote-area delivery, strikes or other circumstances outside our reasonable control.

Customers are responsible for providing a correct delivery address and contact details.

Additional delivery charges resulting from an incorrect address supplied by the customer may be payable by the customer.

International customers are responsible for any applicable customs duties, import taxes, clearance charges or other charges imposed by the destination country.

 

11. PRODUCTION AND DELIVERY TIMES

Where a product is made to order, production begins after payment has been received.

Our products may require approximately 6–9 weeks for printing and sewing/manufacturing, depending on the product and production schedule.

Courier transit time is additional to manufacturing time.

We will make reasonable efforts to meet the estimated timeframes communicated to you.

If an unexpected delay occurs, we will communicate with you as soon as reasonably possible.

 

12. RETURNS, EXCHANGES AND REFUNDS

We want you to be happy with your purchase.

If goods are defective, unsafe, materially different from their description or otherwise subject to a remedy under the CPA, you retain your statutory consumer rights.

Please contact us as soon as possible after receiving an order if there is a problem.

For a return relating to a defect or incorrect product, please provide:

• your order number;

• a description of the problem; and

• clear photographs where appropriate.

We will assess the issue and provide the appropriate remedy in accordance with applicable law.

 

Change-of-mind returns

Where a customer simply changes their mind, returns or exchanges are subject to the applicable legal rights and our stated return policy.

Made-to-order, personalised or customised products may be excluded from voluntary change-of-mind returns where permitted by law.

Nothing in these Terms & Conditions removes or limits any mandatory consumer rights that cannot legally be excluded.

 

Refunds

Where a refund is approved, it will normally be made using the original payment method, where reasonably possible.

Refund processing times may depend on the payment provider or bank.

 

13. DAMAGED GOODS

Please inspect your order when it arrives.

If your order arrives damaged, contact us as soon as reasonably possible with photographs of:

• the packaging;

• the damaged product; and

• the courier label or tracking information.

We will assess the damage and arrange an appropriate remedy where applicable.

 

14. SALE ITEMS AND SPECIAL OFFERS

Sale prices and promotional offers are valid only for the period stated.

Promotional offers may be subject to additional terms displayed with the promotion.

A promotion cannot normally be applied retrospectively to an order already placed unless we expressly agree otherwise.

 

15. WHOLESALE ORDERS

Wholesale customers may be subject to separate wholesale pricing, minimum order quantities, payment terms and delivery arrangements.

Wholesale orders are subject to availability and production capacity.

Wholesale customers may be required to apply for or join our wholesale community before accessing wholesale pricing.

Separate wholesale terms may apply to approved wholesale customers.

 

16. ARTWORK COPYRIGHT AND INTELLECTUAL PROPERTY

All artwork, paintings, illustrations, designs, photographs, product designs, logos, branding, website text and other creative content displayed on this website are owned by or licensed to Adéle Geldenhuys Art unless otherwise stated.

Copyright remains with the artist.

Purchasing an original artwork, print or product does not transfer copyright or reproduction rights to the purchaser.

No artwork may be:

• copied;

• scanned;

• reproduced;

• printed;

• digitally altered for commercial use;

• used on another product;

• resold as artwork;

• used for advertising or merchandising;

without prior written permission from Adéle Geldenhuys Art.

Unauthorised reproduction may constitute copyright infringement.

 

17. COMMISSIONS

Commissioned artwork is produced according to an agreed brief.

A deposit may be required before work begins.

The customer is responsible for providing accurate information, reference photographs and specifications.

Changes to an approved commission may result in additional costs and may affect the completion date.

The final artwork remains the intellectual property of the artist unless a separate written copyright agreement has been made.

 

18. PRODUCT IMAGES

Product images are intended to provide an accurate representation of the product.

Because products may be photographed under different lighting conditions and viewed on different screens, colours may vary slightly from the physical product.

Props and accessories shown in photographs are not included unless specifically stated in the product description.

 

19. PRIVACY AND PERSONAL INFORMATION

We respect your privacy.

Personal information collected through the website may include your name, contact details, delivery address, billing information and information necessary to process your order.

Personal information will be handled in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (“POPIA”).

Information may be shared with payment processors, couriers, manufacturers or service providers where reasonably necessary to process and fulfil an order.

We will not sell your personal information to third parties.

20. EMAIL AND MARKETING

Where you choose to receive marketing communications, we may send information about new artwork, products, workshops, promotions and other updates from Adéle Geldenhuys Art.

You may unsubscribe from marketing communications at any time.

Transactional communications relating to an order, payment or delivery may still be sent where necessary.

 

21. WEBSITE SECURITY

We take reasonable steps to protect our website and customer information.

However, no online transmission or electronic storage system can be guaranteed to be completely secure.

Customers should take reasonable precautions when using the internet, including protecting their passwords and devices.

 

22. THIRD-PARTY SERVICES

Our website may use third-party services such as payment providers, courier companies, hosting services, analytics services and social-media platforms.

We are not responsible for the independent policies, availability or operation of third-party services.

Third-party websites accessed through links from our website are used at the user's own risk.

 

23. WEBSITE AVAILABILITY

We aim to keep our website available and accurate, but we do not guarantee that the website will always be uninterrupted, error-free or available.

The website may occasionally be unavailable because of maintenance, technical problems, hosting issues or circumstances beyond our reasonable control.

 

24. LIMITATION OF LIABILITY

Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.

Subject to applicable law, Adéle Geldenhuys Art will not be responsible for indirect or consequential loss arising from circumstances outside our reasonable control.

Nothing in these Terms & Conditions limits liability for matters where such limitation is prohibited by law.

 

25. EVENTS BEYOND OUR CONTROL

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control.

This may include natural disasters, severe weather, fire, strikes, transport disruptions, supplier failures, power or telecommunications failures, government restrictions, civil unrest or other similar events.

We will take reasonable steps to minimise the effect of such events.

 

26. COMPLAINTS

We want to resolve complaints fairly and promptly.

Nothing in this section prevents a consumer from exercising any rights available under South African consumer-protection legislation.

 

27. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the consumer's rights under applicable legislation.

 

28. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time.

The latest version will be published on this website with the effective date.

Changes will not remove or reduce rights that a consumer has already acquired under applicable law.

 

29. SEVERABILITY

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be interpreted or removed to the extent necessary, while the remaining provisions will continue to apply.

 

30. ENTIRE AGREEMENT

These Terms & Conditions, together with the relevant product description, order confirmation, Privacy Policy and any specific written agreement between the customer and Adéle Geldenhuys Art, form the applicable agreement for the relevant transaction.

Where mandatory South African law provides a consumer with a greater right or protection than these Terms & Conditions, the law will prevail.
